TERMS & CONDITIONS

Last Updated: 10 October 2026

Part 1: Terms and Conditions

Effective date: 10 October 2026

These Terms and Conditions ("Terms") form a binding agreement between you and Wolf Performance Strength & Conditioning, a Colorado limited liability company doing business as Wolf Performance ("Wolf Performance," "we," "us" or "our"). They govern your use of www.WolfPerformancesc.com and every program, product and service we provide. Please read them carefully. They contain an assumption of risk, a release of liability, a limitation of liability and a binding dispute resolution clause.

1. Acceptance of These Terms

You accept these Terms by checking the acceptance box at checkout or registration, by purchasing or accessing any Service, or by participating in any session. If you do not agree, do not purchase or use the Services.

You must be at least 18 years old and legally able to enter contracts to accept these Terms. A participant under 18 ("Minor") may use the Services only if a parent or legal guardian accepts these Terms and signs the Parent/Guardian Release in Part 3 on the Minor's behalf.

2. Definitions

  • "Services" means everything we provide, including the items listed in Section 3, the website, apps, emails, videos, documents and communications.

  • "Programs" means any workout, training plan, conditioning protocol, exercise instruction, nutrition or fueling guide, or other training content we provide in any format.

  • "Content" means all text, video, images, spreadsheets, PDFs, audio and other materials within the Services.

  • "You" means the person accepting these Terms. Where a parent or guardian accepts for a Minor, "you" includes both the parent or guardian and the Minor.

3. Services We Offer

We may offer any of the following. Each is subject to these Terms and to any product-specific details shown at purchase:

  • Downloadable or online training Programs (one-time purchase)

  • Subscription or membership access to Programs and Content

  • Remote or online coaching, including program design, check-ins and video form review

  • In-person training, team sessions, camps and clinics

  • Youth athlete development and academy programs

  • Educational seminars, presentations and printed or digital guides, including nutrition and fueling guides

4. Accounts

You agree to give accurate, current information and to keep it updated. You are responsible for keeping your login secure and for all activity under your account. Accounts are personal and may not be shared.

We do not knowingly collect personal information directly from children under 13. Accounts for participants under 13 must be created and managed by a parent or guardian.

5. Your Health and Safety Responsibilities

Strength and conditioning training is physically demanding and carries a risk of injury. By using the Services, you agree that:

  1. Medical clearance. You will consult a physician before starting any Program, and again after any injury, illness, surgery, pregnancy or change in health. You will not participate if a physician has advised against it.

  2. Honest disclosure. You will truthfully complete any health questionnaire we provide and tell us promptly about any change in your health.

  3. Remote training is unsupervised. When you follow a Program outside an in-person session, no Wolf Performance coach is present. You alone are responsible for how, when and where you train.

  4. Technique and load. You are responsible for learning proper technique before attempting any exercise, choosing loads within your ability, and progressing gradually. If you are new to lifting, you should seek qualified in-person instruction before attempting barbell, Olympic, plyometric or maximal-effort work.

  5. Equipment and environment. You are responsible for the condition of your equipment, using collars and safety bars, having a qualified spotter when appropriate, and training in a safe space.

  6. Stop when something is wrong. You will stop immediately and seek medical help if you feel pain, dizziness, faintness, chest discomfort, shortness of breath beyond normal exertion, or any other warning sign.

  7. General programs. Unless you have purchased individualized coaching, Programs are general and are not designed for your specific health, injury history, age or ability. You are responsible for deciding whether a Program is appropriate for you and for modifying it as needed.

6. Not Medical, Therapy or Dietetic Services

Wolf Performance provides fitness and athletic training education. We are not physicians, physical therapists, athletic trainers (unless stated), registered dietitians or other licensed healthcare providers. Nothing in the Services is medical advice, diagnosis or treatment.

Nutrition, fueling and hydration Content is general education for healthy athletes. It is not medical nutrition therapy and is not intended to diagnose, treat or manage any disease, allergy, eating disorder or medical condition. Athletes with a medical condition, food allergy or special dietary need should consult a physician or registered dietitian. Any mention of supplements, caffeine or sports products is informational, not a recommendation to use them.

7. No Guarantee of Results

Results depend on many factors outside our control, including effort, consistency, genetics, sleep, nutrition, health and coaching received elsewhere. We do not guarantee any specific result, including strength gains, speed, body composition, injury prevention, team selection, scholarships or professional contracts. Testimonials and example results are individual experiences and are not typical or promised outcomes.

8. Pricing and Payment

Prices are in U.S. dollars and are shown at checkout, plus any applicable taxes. Payments are handled by third-party payment processors, and you authorize us and our processors to charge your chosen payment method for all amounts due. We may change prices at any time, but a change will not affect a purchase already completed.

9. Subscriptions and Automatic Renewal

Subscriptions renew automatically at the end of each billing period at the then-current price, and your payment method will be charged, until you cancel. Before you subscribe, we will clearly show the price, billing frequency and how to cancel.

  • How to cancel: Please Contact Me Directly at@Garrick Grantz

  • When cancellation takes effect: at the end of the current billing period. You keep access until then.

  • Price changes: we will notify you by email at least [30] days before a price change applies to your subscription, and you may cancel before it takes effect.

  • Free trials or promotional pricing: we will state when the trial or promotion ends and what you will be charged afterward.

10. Refunds and Cancellations

  • Digital Programs and downloadable Content: all sales are final once the Program is delivered or accessed, because digital content cannot be returned. If a file is defective or inaccessible, contact us within [7] days and we will fix or replace it.

  • Subscriptions: no refunds or credits for partial billing periods, except where required by law.

  • Remote coaching packages: you may cancel within [7] days of purchase for a full refund if coaching has not begun. After coaching begins, fees are non-refundable [or: refundable pro rata for unused full months].

  • In-person sessions: sessions cancelled with at least [24] hours' notice may be rescheduled. Late cancellations and no-shows are forfeited. Session packages expire 6 months after purchase.

  • Youth programs, camps and clinics: [REFUND SCHEDULE, e.g. full refund up to 14 days before start; 50% up to 7 days before; no refund after]. Refunds for injury or medical reasons are at our discretion with a physician's note.

  • Chargebacks: please contact us before disputing a charge. We may suspend access while a dispute is open.

11. Intellectual Property and License

All Programs and Content are owned by Wolf Performance or our licensors and are protected by copyright, trademark and other laws. When you purchase or subscribe, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Programs for your own training (or, for a parent, your own child's training).

You may not copy, share, resell, redistribute, publicly post, upload to file-sharing sites, adapt into your own products, or use any Program to train other people for pay, without our written permission. Team, club or coach licenses are available separately. We may end your license and access, without refund, if you violate this Section.

12. Your Content, Photos and Videos

If you send us videos, photos, training logs or messages (for example, for form review or check-ins), you keep ownership. You grant us a license to use them to deliver and improve your coaching.

We will not use your name, image, video or testimonial in marketing without your separate written consent, and for a Minor, the written consent of a parent or guardian. You may withdraw marketing consent at any time for future use.

13. Acceptable Use

You agree not to misuse the Services, including by harassing coaches or other participants, sharing account access, attempting to access systems you are not authorized to use, uploading harmful code, or using the Services for anything unlawful. We may suspend or terminate access for violations.

14. Third-Party Links, Products and Facilities

The Services may reference or link to third-party equipment, products, apps, websites or facilities. We do not control and are not responsible for them, and your use of them is at your own risk and subject to their terms. If we earn a commission on a recommended product, we will disclose it.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, PROGRAMS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT ANY PROGRAM IS SAFE OR SUITABLE FOR YOU. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY COLORADO LAW:

  1. WOLF PERFORMANCE AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, COACHES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICES.

  2. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

  3. THESE LIMITS APPLY WHETHER THE CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER THEORY, EXCEPT WHERE COLORADO LAW DOES NOT ALLOW A LIMITATION, SUCH AS FOR WILLFUL AND WANTON CONDUCT.

17. Indemnification

You agree to defend, indemnify and hold harmless Wolf Performance and its owners, members, managers, employees, coaches, contractors and agents from any claims, losses, damages, costs and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Services or Programs; (b) your violation of these Terms; (c) inaccurate health information you provide; or (d) any claim brought by a third party, including a Minor or family member, relating to your participation or the Minor's participation.

18. Assumption of Risk and Release

The Assumption of Risk, Release, Waiver of Liability and Indemnity Agreement in Part 2, and for Minors the Parent/Guardian Release in Part 3, are part of these Terms. By accepting these Terms, you also accept those agreements.

19. Dispute Resolution

  1. Informal resolution first. Before filing any claim, you agree to email @Garrick Grantz describing the dispute and to try in good faith to resolve it for 30 days.

  2. Mediation, then binding arbitration. If the dispute is not resolved, either party may request non-binding mediation in Boulder County, Colorado. If mediation fails, the dispute will be resolved by binding arbitration before a single arbitrator under the Colorado Uniform Arbitration Act, in Boulder County, Colorado. [ATTORNEY TO CONFIRM: arbitration provider, fee allocation, and whether to use arbitration at all.]

  3. Small claims. Either party may bring an individual claim in Colorado small claims court instead, if it qualifies.

  4. Individual claims only. To the extent permitted by law, claims must be brought individually and not as part of a class or representative action.

  5. Time limit. Any claim must be brought within one year after it arises, unless Colorado law requires a longer period.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Subject to Section 19, any court action will be brought only in the state or federal courts located in Boulder County, Colorado, and you consent to their jurisdiction.

21. Privacy

Our Privacy Policy explains how we collect, use and protect personal information, including health questionnaire responses and information about Minors. Health information you give us is used only to deliver and adjust your training and is not sold.

22. Changes to These Terms

We may update these Terms from time to time. We will post the new version with a new effective date and, for material changes, notify active customers by email. Changes apply to purchases made after the effective date. Continued use after notice means you accept the updated Terms.

23. Suspension and Termination

We may suspend or end your access if you violate these Terms, misuse the Services, or create a safety risk. You may stop using the Services at any time. Sections 5 through 7, 11, 12 and 15 through 24, and Parts 2 and 3, survive termination.

24. General Terms

  • Entire agreement. These Terms, Parts 2 through 5, the Privacy Policy and any product-specific terms shown at purchase are the entire agreement between you and us.

  • Severability. If any provision is found unenforceable, it will be enforced to the maximum extent allowed and the rest remains in effect.

  • No waiver. Our failure to enforce a provision is not a waiver of it.

  • Assignment. You may not transfer these Terms. We may assign them in connection with a sale or reorganization of our business.

  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including weather, facility closures, illness, outages or government orders.

  • Electronic agreement. You agree that checking an acceptance box or typing your name is your electronic signature and has the same effect as a handwritten signature.

  • Independent contractors. Coaches may be employees or independent contractors of Wolf Performance.

Part 2: Assumption of Risk, Release, Waiver of Liability and Indemnity Agreement (Adult Participants)

READ CAREFULLY. BY ACCEPTING THIS AGREEMENT YOU GIVE UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE WOLF PERFORMANCE FOR INJURIES CAUSED BY ITS NEGLIGENCE.

This Agreement is between the undersigned participant ("Participant") and [LEGAL ENTITY NAME] d/b/a Wolf Performance, together with its owners, members, managers, employees, coaches, contractors, volunteers, agents, successors and assigns, and any facility owner or operator where Wolf Performance conducts sessions (together, the "Released Parties").

1. Activities Covered

This Agreement covers all participation in Wolf Performance Services, whether in person or remote, supervised or unsupervised, including: strength training with free weights, barbells, dumbbells, kettlebells and machines; Olympic lifts and their variations; plyometrics, jumping and landing; sprinting, agility, change of direction and conditioning; speed, resistance-band and sled work; mobility and flexibility work; sport-specific drills; testing and assessments (including maximal-strength, speed and fitness tests); following written or video Programs; and following nutrition, fueling and hydration guidance (the "Activities").

2. Known and Unknown Risks

I understand that the Activities are inherently and potentially dangerous and involve risks that cannot be eliminated, even when performed correctly and with care. These risks include, but are not limited to:

  • Muscle strains, tears and soreness; ligament and tendon injuries; sprains, dislocations and fractures

  • Back, neck, spinal, joint and disc injuries

  • Injuries from dropped, falling or failing equipment, or from collisions with equipment, surfaces or other people

  • Heat illness, dehydration, overexertion, fainting and exertional rhabdomyolysis

  • Cardiac events, stroke and, in rare cases, death

  • Aggravation of pre-existing or undiagnosed conditions

  • Adverse reactions to foods, drinks, sports products or changes in diet

  • Injuries resulting from my own technique, load selection, fatigue, or failure to follow instructions

  • Injuries resulting from the condition of facilities, surfaces, weather or equipment I or others provide

  • Injuries resulting from the ordinary negligence of the Released Parties, including in designing, selecting, describing, demonstrating, modifying or supervising any Activity or Program

3. Remote and Unsupervised Training

I understand that when I follow a Program remotely, no Wolf Performance coach is present to observe my technique, spot me, check my equipment or stop me. I accept full responsibility for my training environment, equipment, technique, load selection, spotting and decision to perform any exercise. I understand that a Program is not adapted to my individual health or ability unless I purchased individualized coaching.

4. My Representations

I represent that: (a) I am at least 18 years old; (b) I have consulted, or had the opportunity to consult, a physician and am physically able to participate; (c) I have truthfully answered any health questionnaire; (d) I will notify Wolf Performance of any change in my health; and (e) I will stop and seek medical help if I feel pain or any warning sign.

5. Voluntary Assumption of Risk

I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS OF THE ACTIVITIES, BOTH KNOWN AND UNKNOWN, INCLUDING RISKS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, and I accept full responsibility for any injury, illness, death, or property damage I suffer.

6. Release and Waiver of Liability

In exchange for being allowed to participate, I RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE RELEASED PARTIES from any and all claims, demands, losses, damages and causes of action of any kind, for bodily injury, illness, death or property damage, arising out of or related to the Activities or the Services, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES.

This release does not apply to claims arising from the willful and wanton conduct of a Released Party, or to any claim that cannot be waived under Colorado law.

7. Indemnification

I agree to indemnify, defend and hold harmless the Released Parties from any claims, losses, damages, costs and attorneys' fees brought by me or anyone on my behalf, including my heirs, family members, estate or insurers, that arise from my participation in the Activities, including claims alleging negligence of the Released Parties.

8. Medical Treatment

If I am injured or ill during an in-person session, I authorize the Released Parties to obtain emergency medical treatment for me. I am responsible for all costs of that treatment and transport. The Released Parties have no obligation to provide medical care beyond basic first aid and calling emergency services.

9. Media

Photos or video taken during sessions may be used to deliver coaching. They will be used in marketing only with my separate written consent, as described in Section 12 of the Terms.

10. Scope, Duration and Governing Law

This Agreement applies to all of my past, present and future participation in the Activities and stays in effect until I revoke it in writing; revocation does not affect claims arising before it. It is governed by Colorado law. It is intended to be as broad and inclusive as Colorado law permits. If any part is held invalid, the rest remains in full force. It binds me, my heirs, executors, administrators and assigns.

11. Acknowledgment

I HAVE READ THIS AGREEMENT, I UNDERSTAND IT, AND I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE. I HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS AND TO CONSULT A LAWYER. I SIGN IT VOLUNTARILY.

Part 3: Parent/Guardian Consent, Assumption of Risk and Release for Minor Participants

READ CAREFULLY. BY SIGNING, YOU GIVE UP YOUR CHILD'S RIGHT, AND YOUR OWN RIGHT, TO SUE WOLF PERFORMANCE FOR INJURIES CAUSED BY ITS NEGLIGENCE.

This release is made under Colorado Revised Statutes § 13-22-107, which allows a parent or legal guardian to release, on behalf of a child, prospective claims for negligence arising from the child's participation in sporting, recreational and educational activities.

Minor's name: ______________________________ Date of birth: ______________

Parent/guardian name: ______________________________

1. Consent to Participate

I am the parent or legal guardian of the Minor named above, and I have legal authority to sign for the Minor. I give permission for the Minor to participate in the Activities described in Part 2, Section 1, including in-person sessions, team sessions, camps, clinics, remote Programs and youth academy programs.

2. Risks

I have read the risks listed in Part 2, Section 2, and I understand that they apply to the Minor. I understand that youth athletes may face additional risks related to growth and development, coordination, and judgment, and that remote Programs are performed without a Wolf Performance coach present.

3. Supervision of Remote Training

For any Program the Minor follows outside an in-person session, I accept responsibility for ensuring the Minor is supervised by a responsible adult, uses safe equipment and an appropriate training space, and does not attempt exercises or loads beyond what has been taught and approved by a qualified coach.

4. Health Information

I confirm that the Minor has been cleared for sports participation by a physician (for example, a current sports physical) and that I have truthfully completed any health questionnaire. I will tell Wolf Performance promptly about any injury, illness, concussion, medication change or other change in the Minor's health.

5. Assumption of Risk

ON BEHALF OF THE MINOR AND MYSELF, I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS OF THE ACTIVITIES, KNOWN AND UNKNOWN, INCLUDING RISKS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.

6. Release of Prospective Negligence Claims

PURSUANT TO C.R.S. § 13-22-107, ON BEHALF OF THE MINOR, MYSELF, AND OUR HEIRS, EXECUTORS AND ASSIGNS, I RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE RELEASED PARTIES (as defined in Part 2) from any and all claims for bodily injury, illness, death or property damage arising out of or related to the Minor's participation in the Activities, INCLUDING CLAIMS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

As Colorado law requires, this release does not apply to claims arising from willful and wanton, reckless, or grossly negligent acts or omissions.

7. Parent/Guardian Indemnity

[ATTORNEY TO REVIEW: Colorado courts have questioned whether a parent's promise to indemnify against the child's own claims is enforceable.] I agree to indemnify and hold harmless the Released Parties from claims brought by me or by any other person on the Minor's behalf that are released by this Agreement, including reasonable attorneys' fees, to the extent permitted by Colorado law.

8. Emergency Medical Authorization

If the Minor is injured or ill and I cannot be reached, I authorize the Released Parties to call emergency services and to consent to emergency medical treatment for the Minor. I am responsible for all costs.
